The arbitration shall be conducted in English and shall take place in the United States, at a location mutually agreed upon by the parties or as determined by the arbitrator. The arbitrator's decision shall be final and binding on both parties and may be entered as a judgment in any court of competent jurisdiction.

The arbitrator shall have the authority to award any remedy that would be available in a court of law, except that the arbitrator may not award punitive damages unless the claim involves intentional misconduct.

10.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both parties agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.

10.4 Small Claims Court

Notwithstanding the foregoing agreement to arbitrate, either party may elect to have disputes or claims resolved in a small claims court of competent jurisdiction, provided that the amount in controversy falls within the jurisdictional limits of such court and the claim is brought on an individual (non-class) basis.

10.5 Opt-Out
